Adjudication of Penalties under Companies Act

It comes to our Notice that Jurisdictional Registrar of Companies started taking a strict approach with respect to compliances which needs to be done/fulfilled by the Companies. The penalty orders are being passed concerning non-compliance. Our team is providing the advisory, drafting and representational Services before the Registrar of Companies in the adjudication matters. Even if the Jurisdictional Roc has passed the order of penalty for certain offence, the company and its officers have the power to file the appeal before the Jurisdictional Regional Director, Ministry of Corporate Affairs who vests the power to reduce the penalty considering the gravity of the offence and even waive off the whole penalty if he deems fit by passing an order in favor of the company. Now a days , this becomes the most important part because the most of work of forms approval already shifted from the Registrar office to the centralized Unit of Ministry of Corporate Affairs knows CPC. The jurisdictional ROC are now the mainly exercising the scrutiny, complaint, inquiry and investigation matters of the Companies Act,2013.
